Terms of Use for 1 day Activities

WARNING

Mountaineering, climbing, mountaineering, canyoning, caving, and ski touring are inherently dangerous and high-risk sports. The natural environment in which they are practiced is changing and unsafe, so their practice requires prior acceptance of this fact. Safety, progression, and descent techniques are intended to minimize the chances of an accident. However, since complete safety does not exist in the practice of these sports and the residual risk remains considerable, Yurok will not be responsible for any conditions that may arise from the practice of these sports, even if they have been performed correctly.

APPLICABLE REGULATIONS

These general conditions are subject to the provisions of Law 7/1998, of April 13, on general contracting conditions, Royal Decree 1906/1999 of December 17, 1999, regulating telephone or electronic contracting with general conditions, Law 26/1984 of July 19, on the general protection of consumers and users, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996 of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.

PURPOSE

These general conditions are intended for the rental of mountain guide services. These services will be provided through the organization of excursions, expeditions, and training courses, both within and outside Spain.

ACCEPTANCE OF TERMS AND CONDITIONS

The contracting of the services provided herein necessarily requires the full and unreserved acceptance of each and every one of the general terms and conditions of the contract.

By accepting this contract, you declare that you are of legal age and have the legal capacity established by the legislation of your country of nationality.

If you are acting on behalf of a legal entity, by accepting these general terms and conditions, you declare that you have the appropriate powers of representation.

In this type of program, participants must be in a physical and technical condition that allows them to progress independently under the supervision and safety of the guide. In order to assess your capabilities, it is necessary to carefully read the technical sheets and make any inquiries deemed necessary to identify the level required for the program or activity.

COURSE CHANGES

On-site, the guide may modify the program based on weather and mountain conditions to ensure safety. Likewise, if the participants' level is not suitable for the activity, the guide will modify the program to suit their level. All professionals are duly qualified to conduct these programs and have the company's Civil Liability insurance.

GUIDE RESPONSIBILITY

The activity guide is ultimately responsible for the activity, making the most appropriate decisions for its proper functioning, taking into account weather conditions and the physical and mental fitness of the participants.

Participants agree to comply with the guide's instructions. Failure to comply with these instructions will result in both the organization and the guide disclaiming all liability for any consequences that may arise, which may result in the expulsion of the participant or even the suspension of the activity, with the loss of all rights.

RIGHT OF ADMISSION

The organizers and, where applicable, the activity guide, reserve the right to refuse admission to any person who is not in adequate physical, mental, or technical condition to participate in the activity.

Likewise, any person who does not show up at the start of the activity with the material specified in the REQUIRED MATERIAL section will not be allowed to participate, always at the guide's discretion.

The situations specified above result in the loss of all rights by the participant and forfeiture of the activity fee.

RESERVATIONS

Reservations must be made at least one day in advance of the activity's start date, subject to availability. Payment must be made at the price indicated in each program by bank transfer, card, or cash. Cash payments can only be made at our center in Alcorcón. An activity is considered reserved from the moment the payment indicated in each program is received.

Once the reservation has been made by the client, no cancellations are permitted. Any cancellation by the client will not be eligible for a refund.

Reservations can be modified up to 5 days in advance and will not incur any cost to the client. Reservations cannot be modified 4 days before the booked activity, and if the client does not show up, the activity will be considered completed.

Once payment has been made, a receipt will be sent; if requested, it must be presented to the guide at the start of the activity.

If there is a waiting list by the activity deadline, reserved but not fully paid-for spots will be filled by those on the waiting list.

Minors must provide parental consent on the day of the activity, along with a photocopy of their parent's or guardian's ID.

PRICES

Activity prices include VAT. Everything included in the price will be specified in each activity or program listing.

In the event that the scheduled activity is extended due to weather or force majeure, all expenses incurred will be borne by the customers.

In the event that special offers are posted on the website, the duration of these offers will be solely and exclusively for the duration of their stay on the website.

Cash payments are only accepted at our Alcorcón center.

ACTIVITY CANCELLATION

All activities require a minimum group size. If the minimum group size is not met, Yurok reserves the right to cancel the activity and reschedule it. In this case, the client has the right to request a refund or change the date.

To refund a reservation due to not meeting the minimum group size, please email us at reservas@yurok.es, including your reservation number and an account number for the transfer. All refunds will cost €1 per person. That is, if the reservation was made for 3 people, the refund fee will be €3, and the amount paid less the €3 cancellation fee will be refunded.

Yurok reserves the right to cancel an activity on the day of the activity due to force majeure or imminent danger due to weather conditions. The client may participate in the same or a similar activity on another date.

Yurok reserves the right to cancel the activity for clients who lack the necessary capacity to undertake certain activities or due to their dangerous or violent behavior. In the first case, an activity appropriate to their capacity will be sought, and in the second and third cases, the activity will be suspended, and the client will not be entitled to a refund of the activity fee.

APPLICABLE LAW AND JURISDICTION

The parties acknowledge that the law applicable to this contract shall be Spanish law. The parties also agree to submit to the courts and tribunals of Madrid for the resolution of any controversy, conflict, or claim arising from this contract, as this is the place where the contract was signed, expressly waiving any other jurisdiction that may apply.

NOTIFICATIONS

All notifications, requests, petitions, and other communications to be made by the parties in relation to these General Conditions must be made in writing and will be deemed to have been duly made when delivered by hand, or sent by regular mail to the other party's address or email address, or to any other address or email address that each party may indicate to the other for these purposes.
